This Free Coaching Client Agreement is Made Between
Coach, Heather Allison, www.heather-allison.com, Be In Love Services, The Golden Way LLC
and
You, the Coachee/Client ("You")
You and Heather Allison hereby agree to the following:
A Free coaching Session
You are entering into a free coaching session whereby Heather Allison will provide high level coaching to You within an approximately 30-minute session.
Sessions will be held either in the private Facebook group, Rise Goddess, or on Zoom and streamed into Rise Goddess. Audio of Heather’s reflections may also be used elsewhere more publicly, but will not include your name, voice or likeness. Only your question, or part of your question, will be shared for context, and no personal details will be included.
Clients chosen for Free Coaching Sessions will be chosen wholly at the Coach’s discretion, and you are not guaranteed to be chosen for Free Coaching.
Limits on coaching calls: Heather Allison reserves the right to reschedule any coaching calls to accommodate holidays, health, travel and other needs as necessary.
Supplemental support: No additional support will only be provided outside of this Free Session. Additional Coachee support may be provided only through additional purchased support, or through another program you are currently enrolled in, if applicable, provided there is personal support included in said program.
Cost of the Session: As a part of the agreed upon release of content, audio, video, likeness, voice and any and all personal information shared in sessions, the cost of this session is FREE to the Coachee.
Cost of telephone calls and other costs incurred: Unless otherwise agreed upon, You are responsible for initiating the call to any session, and You bear the cost of the telephone call, internet services and all other costs incurred. An audio Internet link is also available for clients who prefer this.
Terms
This agreement, will begin upon acceptance, and will continue for as long as services are offered by the Coach. The requirement for receiving this Free Coaching Session is agreement to this Client Agreement and the Release of rights to all content contained and created in this free coaching program in full.
The services to be provided by the coach to the client are coaching or tele-coaching, as designed jointly with the client. Coaching, which is not advice, therapy or counseling, may address specific personal projects, business successes, or general conditions in the client's life, relationships, or profession.
Gift to the Coachee is to include:
One (1) free session of coaching provided by Coach on recorded video conference platform or private social media group.
Payment
Coachee will be receiving free Coaching services from Heather Allison, www.heather-allison.com, Be In Love Services and The Golden Way and there is no monetary incentive or compensation for the Coachee included in this offer. Coach may also terminate services if, in our sole opinion, Coachee is conducting him/herself or their business in a manner which is disparaging or disruptive to Heather Allison or infringes upon Be In Love Services or The Golden Way, or violates the confidentiality covenant stated below, or for any other reason, and in no event will any funds or compensation be issued in exchange for this program nor for early termination for any reason.
Cancellations and No Shows
By entering this program and signing this Agreement, you are Committing to participate in the program in good faith and intention.
All one-on-one sessions with Heather Allison are non-refundable and non-transferrable. There is no penalty for sessions cancelled via email with 24 hour notice, or within reason during emergency situations. Heather Allison, Be In Love Services and The Golden Way LLC are under no obligation to offer compensation for or reschedule a coaching session if You fail to complete or appear for any or all of your private or group coaching sessions. Rescheduling may or may not be allowed, and is to be determined wholly at Coach’s discretion. Request for rescheduling may, instead, result in forfeit of Free Coaching Session offer.
Confidentiality
Coach has the full right and release to use any client stories which are shared in sessions and in writing on any channel or platform, including blog, podcast, social media, video, tele course or other medium for marketing or coaching purposes, or within a program or course for sale. Coach has the right to use case studies or examples of Client’s situations and results or Client testimonials in future work but will never make reference to Client’s full name, unless provided with written approval from the Client.
The Coach reserves the right to record and/or photograph any session for review by a confidential certification committee for ongoing coach training and certification purposes only. The Coach reserves the right to use any photograph/video, without the expressed written permission of Client, however to ensure the privacy of Client, images will not be identified using full names or personal identifying information without written approval from Client, and no Session will ever be made public. If Client does not wish to have their session recorded for training purposes must make their wishes known to Company in writing.
I understand that all sessions, both group or private, will be recorded via the Internet or telephone for my benefit, knowing that the use of technology is not always secure. I accept the risks of error, either technological or human, with regard to confidentiality of my information through the use of email, text, Facebook, posts at heather-allison.com, Skype and other uses of technology either by me or to me. I understand and accept the risks related to sharing personal information with the other members of the program and other paying clients, and I will not hold Heather Allison, www.heather-allison.com, Be In Love Services or The Golden Way LLC liable or responsible for any information shared by other members outside of this group. I understand that recordings of these calls will be shared with the other members, participants of the same program, and other paying clients. I understand that on occasion, recordings of both private and/or group sessions or classes may not be available due to technological or human error.
Coaching Relationship
Throughout the working relationship, the Coach will engage in direct and personal conversations. The Client can count on the Coach to be honest and straightforward in asking questions and making requests. The Client understands that the power of the coaching relationship can be granted only by the Client, and the Client agrees to do just that: have the coaching relationship be powerful. If the Client believes the coaching is not working as desired, the Client will communicate that belief and take action to return the power to the coaching relationship.
Resale of Service and/or Intellectual Property
No sharing, resale, repurposing or distribution of services, products, content or intellectual property is permitted. Client agrees not to reproduce, duplicate, copy, sell, trade, resell, or exploit, for any commercial or personal purposes, any portion of the Service (including course materials & intellectual property), use of the Service, or access to the Service.
You acknowledge and understand that the methods, processes and strategies taught in Coaching sessions constitute our Proprietary System which is confidential, and for which we claim copyright protection. We have spent considerable time and efforts in developing this Proprietary System, which includes all materials associated with the program, all coaching strategies taught, and all associated coaching advice. You agree to maintain the absolute confidence of Coaching program and our Proprietary System and agree not to duplicate, disseminate, distribute or otherwise disclose any part to any 3rd parties, for any reason, unless required by legal process. You further acknowledge that the Proprietary System and the Program(s) are and shall remain the property of Heather Allison, www.heather-allison.com, Be In Love Services and The Golden Way LLC, and that you shall not infringe upon any part of the Proprietary System nor claim any part as your property, nor attempt to replicate or copy any part for your own competitive benefit. You further agree that your violation of this provision will cause substantial harm to Heather Allison, www.heather-allison.com, Be In Love Services and The Golden Way LLC, and for which we may seek all legal redress, which may include an injunction or substantial damages.
Limitation of Liability
While Heather Allison is absolutely convinced that you will derive great benefits from this service and that You should become as connected with your Sacred Feminine and experience great personal Expansion, We of course cannot represent or guarantee that you will attain certain level of relationship, personal success or emotional wellness as a result of our Coaching Program. As with any coaching relationship, each individual’s success depends on many factors, including your personal motivation, time commitment, how effectively you implement the strategies taught, and your efficiency in following up on each phase. We can guarantee, however that you WILL learn a lot of usable and translatable business strategies for success that, when followed by others, have achieved Life Changing results.
By using the Coach’s services, the Client/Coachee accepts any and all risks, foreseeable or non foreseeable, arising from such transactions and interactions. All claims against the Coach must be lodged with the entity having jurisdiction within 100 days of the date of the first claim or otherwise be forfeited forever. Client / Coachee agrees that the Coach will not be held liable for any damages of any kind, resulting or arising from, including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Service, or from the use or misuse of the recorded content used in marketing and promotional channels. Client / Coachee agrees that use of this Service is at user's own risk.
DISCLAIMER
I understand that I am working with Heather Allison for professional Love and Life Coaching in exchange for the release of my name, voice, words, image, likeness and appearance within the provided Coaching sessions for marketing and promotional purposes, for use ONLY within the agreed-upon Rise, Goddess Facebook group.
I understand that the recording of reflections offered by Heather Allison may be shared more broadly, publicly, and may include some of my words for context, but that this will be done wholly without my name, voice, image, likeness, personal details or appearance, unless I grant explicit permission.
I understand that professional coaching is distinctly different from counseling, psychotherapy or psychoanalysis and does not deal with the diagnosis or treatment of emotional problems. Since professional coaching does not constitute medical consultation or treatment, health insurance does not apply.
Declaration
As Heather Allison, a relationship consultant, the Coach will be making suggestions, giving homework, advising, taking the Client through exercises and meditations, and teaching the Client the communication and personal techniques developed by the Coach and by Rori Raye. Unlike the co-active coaching aspects of working together, where the Coach may ask questions and walk alongside the Client on his/her journey, rather than tell him/her what the Coach believes is their best course of action, teaching and consulting does require the Coach to lead and guid the Client. It requires the Coach giving information and instruction to the Client. As an ordained (non-denominational) minister, the teaching and consulting from Heather Allison, therefore, is to be considered pastoral advice. The Coach is not a therapist, nor is Coach licensed by the State of Washington in any way. The decision to accept or decline information, instructions, guidance, suggestions, and teachings from the Coach is the Client's to make.
The free Coaching Session is not intended to provide legal, financial or health-related advice. As the Client, I understand that Heather Allison, Be In Love Services, The Golden Way LLC and Free Coaching fall under the category of Life Coaching, and I further I understand that life coaching is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education, sports and recreation. I acknowledge that deciding how to handle these issues and implement my choices is exclusively my responsibility.
As the Client, I understand and agree that I am fully responsible for my well-being during my group coaching sessions, including my choices and decisions. I am aware that I can choose to disregard any advice given during public or private sessions, whether from and intuitive, coaching, health, or business standpoint. I recognize that coaching, mentoring, and intuitive guidance is not psychotherapy and that professional referrals will be given if needed.
As the Client, I understand that Heather Allison and the programs and coaching provided does not treat mental disorders as defined in the DSM-V by the American Psychiatric Association. I understand that the advice and information given in the Program, whether written or spoken, is not a substitute for counseling, psychotherapy; psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of therapy. I agree that I am well adjusted, mentally health and ready to receive coaching and intuitive services. As the Client, I agree that if I am currently in therapy or otherwise under the care of a mental health professional, I have consulted with this person regarding the advisability of working with a life coach or spiritual teacher, or receiving intuitive advice, and that this person is aware of my decision to proceed with the life or spiritual coaching relationship.
By purchasing and entering into any coaching work with Heather Allison, and by participation in and viewing of the content on www.heather-allison.com, the Client hereby agrees to this disclaimer.
